A BILL TO BE ENTITLED
 
AN ACT
  relating to probation of certain disqualifications from driving a
  commercial motor vehicle.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 522.085, Transportation Code, is amended
  to read as follows:
         Sec. 522.085.  PROBATION OF DISQUALIFICATION [PROHIBITED].
  (a)  Notwithstanding Section 521.303, and except as provided by
  Subsection (b), if a person is disqualified under this chapter, the
  disqualification may not be probated.
         (b)  A disqualification under Section 522.081(a) may be
  probated under Section 521.309 for a period not to exceed one year
  if the disqualified person: 
               (1)  attends and successfully completes a driving
  safety course approved by the Texas Department of Licensing and
  Regulation; and
               (2)  does not commit a violation giving rise to a
  disqualification under this chapter during the period of probation.
         (c)  If the department probates a person's disqualification
  under this section, the person may continue to operate a commercial
  motor vehicle under the person's commercial driver's license during
  the period of probation.
         SECTION 2.  This Act takes effect September 1, 2017.
