A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the use of a school as a polling place. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 43.031, Election Code, is amended by |
|
|
adding Subsection (f) to read as follows: |
|
|
(f) Notwithstanding Subsection (c), if the building |
|
|
selected for a polling place under this section is a school, the |
|
|
entity that owns or controls the building may deny the authority |
|
|
holding the election use of the building as a polling place if the |
|
|
entity that owns or controls the building can demonstrate that |
|
|
using the building as a polling place is reasonably likely to result |
|
|
in unsecured access to students on the building's campus. This |
|
|
subsection does not apply if classes are suspended during the time |
|
|
the building is in use as a polling place. The secretary of state |
|
|
shall adopt rules for the administration of this subsection. |

|
SECTION 2. This Act takes effect September 1, 2017. |
