A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to training of peace officers employed by the Department |
|
of Public Safety concerning the enforcement of federal immigration |
|
laws. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 411, Government Code, is |
|
amended by adding Section 411.00961 to read as follows: |
|
Sec. 411.00961. MEMORANDUM OF UNDERSTANDING WITH UNITED |
|
STATES DEPARTMENT OF HOMELAND SECURITY; TRAINING. (a) The |
|
department shall require that each peace officer employed by the |
|
department be trained in accordance with a memorandum of |
|
understanding between this state and the United States Department |
|
of Homeland Security concerning the law enforcement officer's role |
|
in enforcing federal immigration laws, in accordance with 8 U.S.C. |
|
Section 1357(g). |
|
(b) The director has authority to negotiate the terms of the |
|
memorandum described by Subsection (a). |
|
(c) A memorandum described by Subsection (a) must be signed |
|
by the director and by the governor. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
