A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requirements for the construction of a natural gas |
|
|
pipeline in a municipality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 121, Utilities Code, is |
|
|
amended by adding Section 121.105 to read as follows: |
|
|
Sec. 121.105. HEARING BEFORE CONSTRUCTION OF PIPELINE. A |
|
|
person seeking to construct a pipeline to which this chapter |
|
|
applies that is planned to be placed in the corporate boundaries or |
|
|
extraterritorial jurisdiction of a municipality may not begin |
|
|
construction of the pipeline unless the person holds at least one |
|
|
public meeting in the municipality on the proposed construction. |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
the construction of a pipeline that begins on or after the effective |
|
|
date of this Act. Construction that begins before the effective |
|
|
date of this Act is governed by the law in effect immediately before |
|
|
that date, and the former law is continued in effect for that |
|
|
purpose. |

|
SECTION 3. This Act takes effect September 1, 2017. |
