A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the deposit of certain fees for permits for oversize or |
|
|
overweight vehicles to the credit of the Texas Department of Motor |
|
|
Vehicles fund. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 621, Transportation Code, |
|
|
is amended by adding Section 621.357 to read as follows: |
|
|
Sec. 621.357. DEPOSIT OF CERTAIN FEE AMOUNTS TO TEXAS |
|
|
DEPARTMENT OF MOTOR VEHICLES FUND. (a) This section applies only |
|
|
to a provision of this subtitle enacted after January 1, 2017, that |
|
|
authorizes a new permit fee and does not expressly provide for a |
|
|
portion of the fee to be deposited to the credit of the Texas |
|
|
Department of Motor Vehicles fund. |
|
|
(b) Notwithstanding any other provision of this subtitle, |
|
|
10 percent of a fee collected for the issuance of a permit by the |
|
|
department under this subtitle shall be deposited to the credit of |
|
|
the Texas Department of Motor Vehicles fund and the remainder of the |
|
|
fee collected shall be proportionally adjusted, if necessary, and |
|
|
distributed as otherwise provided by this subtitle. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
