A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to obtaining information from the child abuse and neglect |
|
|
central registry regarding certain individuals who have or will |
|
|
have direct contact with public school students. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 22, Education Code, is |
|
|
amended by adding Section 22.0841 to read as follows: |
|
|
Sec. 22.0841. CHILD ABUSE AND NEGLECT CENTRAL REGISTRY |
|
|
INFORMATION CHECK. An entity that is required under this |
|
|
subchapter to obtain criminal history record information for any |
|
|
person who has or will have direct contact with students must also |
|
|
submit the person's name to be checked against the central registry |
|
|
of persons found to have abused or neglected a child maintained by |
|
|
the Department of Family and Protective Services under Section |
|
|
261.002, Family Code. The entity shall consider any information |
|
|
received from the central registry in making a licensing or |
|
|
employment decision regarding the person. |
|
|
SECTION 2. Section 261.002, Family Code, is amended by |
|
|
adding Subsection (g) to read as follows: |
|
|
(g) The department shall provide access to information in |
|
|
the registry for the purpose of a review conducted under Section |
|
|
22.0841, Education Code. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
