A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the creation of an offense prohibiting advertisements |
|
|
on an Internet website of certain prostitution offenses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 43, Penal Code, is amended |
|
|
by adding Section 43.07 to read as follows: |
|
|
Sec. 43.07. ADVERTISEMENT OF PROSTITUTION. (a) A person |
|
|
commits an offense if on an Internet website that is owned or |
|
|
operated by the person the person publishes or distributes an |
|
|
advertisement that contains an offer to engage in sexual conduct in |
|
|
return for receipt of a fee, knowing that the conduct is to be |
|
|
provided or performed by a victim of an offense under Chapter 20A. |
|
|
(b) An offense under this section is a state jail felony, |
|
|
unless it is shown on the trial of the offense that the defendant |
|
|
has been previously convicted of an offense under this section, in |
|
|
which event the offense is a felony of the third degree. |
|
|
SECTION 2. This Act takes effect September 1, 2017. |
