A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the confidentiality of certain licensing and employment |
|
|
records submitted to the Texas Commission on Law Enforcement or |
|
|
maintained by a law enforcement agency. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. S |
|
|
ection 1701.454(a), Occupations Code, is |
|
|
amended to read as follows: |
|
|
(a) All information submitted to the commission under this |
|
|
subchapter, including a copy of that information retained by the |
|
|
submitting law enforcement agency, is confidential and is not |
|
|
subject to disclosure under Chapter 552, Government Code, unless |
|
|
the person resigned or was terminated due to substantiated |
|
|
incidents of excessive force or violations of the law other than |
|
|
traffic offenses. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
