A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a teacher to student ratio requirement for public |
|
school special education programs. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 25.111, Education Code, is amended to |
|
read as follows: |
|
Sec. 25.111. STUDENT/TEACHER RATIOS. (a) Except as |
|
provided by Subsection (b) and Section 25.112, each school district |
|
must employ a sufficient number of teachers certified under |
|
Subchapter B, Chapter 21, to maintain an average ratio of not less |
|
than one teacher for each 20 students in average daily attendance. |
|
(b) For each student enrolled in a special education program |
|
under Subchapter A, Chapter 29, a school district or |
|
open-enrollment charter school must assign a teacher certified |
|
under Subchapter B, Chapter 21, sufficient to maintain a ratio of |
|
not less than one teacher for each three students who receive |
|
special education services in a self-contained classroom or other |
|
special education setting. |

SECTION 2. This Act applies beginning with the 2017-2018 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
