A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the filing of a fetal death certificate after an |
|
abortion. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 171, Health and Safety |
|
Code, is amended by adding Section 171.006 to read as follows: |
|
Sec. 171.006. FETAL DEATH CERTIFICATE REQUIRED. (a) A |
|
physician or physician's agent shall file a fetal death certificate |
|
with the local registrar of the appropriate registration district |
|
in accordance with Chapter 193 and department rules for each death |
|
of an unborn child that occurs as a result of an abortion performed |
|
by the physician regardless of the gestational age of the unborn |
|
child at the time the abortion is performed. |
|
(b) The physician or physician's agent shall provide a copy |
|
of the fetal death certificate to the woman on whom the abortion was |
|
performed. |
|
SECTION 2. Section 171.006, Health and Safety Code, as |
|
added by this Act, applies only to an abortion performed on or after |
|
the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2017. |
