A BILL TO BE ENTITLED
 
AN ACT
  relating to requirements for the use of an insignia or design by
  guard companies under the Private Security Act.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 1702, Occupations Code, is
  amended by adding Section 1702.1305 to read as follows:
         Sec. 1702.1305.  REQUIREMENTS FOR USE OF INSIGNIAS AND
  DESIGNS BY GUARD COMPANIES. (a) This section applies only to a
  person who holds a security services contractor license and acts
  as, offers to provide the services of, or engages in the business of
  a guard company.
         (b)  A person may not use an insignia or design on a uniform
  or motor vehicle that will be used by the person or the person's
  officer, director, partner, manager, or employee while performing
  duties as a guard company under this chapter unless the person:
               (1)  submits the insignia or design to the department;
  and
               (2)  obtains the department's approval to use the
  insignia or design on the uniform or motor vehicle.
         (c)  The board by rule shall prescribe procedures for the
  submission and approval of an insignia or design under this
  section.
         (d)  The rules may require that a person subject to this
  section submit a proposed insignia or design for department
  approval as a part of the person's application for a license if the
  person intends to use an insignia or design in the manner described
  by Subsection (b).
         (e)  The board may not renew the license of a person who
  violates this section or a rule adopted under this section.
         SECTION 2.  Not later than March 31, 2018, the Texas Private
  Security Board shall adopt rules to implement Section 1702.1305,
  Occupations Code, as added by this Act.
         SECTION 3.  Section 1702.1305(e), Occupations Code, as added
  by this Act, applies only to the renewal of a security services
  contractor license that expires on or after September 1, 2018. A
  security services contractor license that expires before that date
  is governed by the law in effect immediately before the effective
  date of this Act, and the former law is continued in effect for that
  purpose.
         SECTION 4.  (a) Except as provided by Subsection (b) of this
  section, this Act takes effect September 1, 2017.
         (b)  Section 1702.1305, Occupations Code, as added by this
  Act, takes effect September 1, 2018.
