A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to approval by the comptroller of public accounts of |
|
|
certain contingent fee legal services contracts entered into by |
|
|
public agencies. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 403.0305, Government Code, is amended to |
|
|
read as follows: |
|
|
Sec. 403.0305. APPROVAL BY COMPTROLLER. A public agency as |
|
|
defined under Section 30.003(3), Water Code, may not enter into a |
|
|
contract as provided by Subchapter C, Chapter 2254, to bring a suit |
|
|
under the Water Code in which the Texas Commission on Environmental |
|
|
Quality is a necessary and indispensable party without review and |
|
|
approval of the contract by the comptroller. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a contract entered into on or after the effective date of this |
|
|
Act. A contract entered into before the effective date of this Act |
|
|
is governed by the law applicable to the contract immediately |
|
|
before the effective date of this Act, and that law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
