A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to restoration of the position of public employees when |
|
|
relieved of duty from the Texas military forces or a similar unit. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 437.202(d), Government Code, is amended |
|
|
to read as follows: |
|
|
(d) An employee of this state, a municipality, a county, or |
|
|
another political subdivision of this state [A state employee] who |
|
|
is a member of the Texas military forces, a reserve component of the |
|
|
armed forces, or a member of a state or federally authorized urban |
|
|
search and rescue team and who is ordered to duty by proper |
|
|
authority is entitled, when relieved from duty, to be restored to |
|
|
the position that the employee held when ordered to duty. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
