A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the posting of notice of intent to obtain a permit from |
|
|
the Texas Commission on Environmental Quality at the site of the |
|
|
facility or proposed facility for which the permit is sought. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 5.552, Water Code, is amended by adding |
|
|
Subsection (c-1) to read as follows: |
|
|
(c-1) At the site of the facility or proposed facility for |
|
|
which an applicant is required to publish notice under this |
|
|
section, the applicant shall place a sign that complies with rules |
|
|
adopted by the commission stating: |
|
|
(1) that an application for a permit for a facility at |
|
|
the site has been filed; and |
|
|
(2) the manner in which the commission may be |
|
|
contacted for further information. |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
an application for a permit that is filed with the Texas Commission |
|
|
on Environmental Quality on or after the effective date of this Act. |
|
|
An application for a permit filed before the effective date of this |
|
|
Act is governed by the law in effect on the date of filing, and that |
|
|
law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
