A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a reduction of amounts appropriated to the Texas |
|
|
Department of Transportation for a violation of provisions relating |
|
|
to public participation in the environmental review of |
|
|
transportation projects. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 201.604, Transportation Code, is amended |
|
|
by adding Subsection (f) to read as follows: |
|
|
(f) If the department violates a requirement relating to |
|
|
public participation in the environmental review of a |
|
|
transportation project under this section or under rules adopted to |
|
|
implement this section, the department is subject to a reduction of |
|
|
amounts appropriated for administration by the General |
|
|
Appropriations Act for the biennium following the biennium in which |
|
|
the violation occurs in an amount not to exceed $100,000 for each |
|
|
violation. |

SECTION 2. This Act takes effect September 1, 2017. |
