A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to regulation by the Texas Department of Transportation of |
|
the spacing along highways of outdoor advertising in |
|
municipalities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 391, Transportation Code, |
|
is amended by adding Section 391.038 to read as follows: |
|
Sec. 391.038. SPACING REQUIREMENTS IN MUNICIPALITIES. (a) |
|
In this section, "electronic sign" means a sign that changes its |
|
message or copy by programmable electronic or mechanical processes. |
|
(b) The department, in regulating outdoor advertising |
|
located in the corporate boundaries of a municipality, may not |
|
consider for the purposes of spacing distances an electronic sign |
|
owned by a political subdivision. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
