A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the personal liability of certain elected officials |
|
under local government programs to fund water and energy savings |
|
improvements through assessments. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 399.015, Local Government Code, is |
|
amended to read as follows: |
|
Sec. 399.015. CONTRACT FOR COLLECTION OF ASSESSMENTS; NO |
|
PERSONAL LIABILITY. (a) The governing body of a local government |
|
may contract with the governing body of another taxing unit, as |
|
defined by Section 1.04, Tax Code, or another entity, including a |
|
county assessor-collector, to perform the duties of the local |
|
government relating to collection of assessments imposed by the |
|
local government under this chapter. |
|
(b) A county assessor-collector who performs the duties of a |
|
local government relating to collection of assessments imposed by a |
|
local government under this chapter is not personally liable as a |
|
result of exercising those duties under this chapter. |
|
SECTION 2. Section 399.019, Local Government Code, is |
|
amended to read as follows: |
|
Sec. 399.019. NO PERSONAL LIABILITY. The members of the |
|
governing body of a local government, other elected officials of a |
|
local government, employees of a local government, and board |
|
members, executives, employees, and contractors of a third party |
|
who enter into a contract with a local government to provide |
|
administrative services for a program under this chapter are not |
|
personally liable as a result of exercising any rights or |
|
responsibilities granted under this chapter. |
|
SECTION 3. Section 399.015, Local Government Code, as |
|
amended by this Act, applies only to a contract executed on or after |
|
the effective date of this Act. A contract executed before the |
|
effective date of this Act is governed by the law in effect when the |
|
contract was executed, and the former law is continued in effect for |
|
that purpose. |
|
SECTION 4. This Act takes effect September 1, 2017. |
