A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the offense of driving while license invalid. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Sections 521.457(e) and (f-1), Transportation |
|
Code, are amended to read as follows: |
|
(e) Except as provided by Subsections [(f),] (f-1)[,] and |
|
(f-2), an offense under this section is a Class C misdemeanor. |
|
(f-1) If it is shown on the trial of an offense under this |
|
section that at the time of the offense, the license of the person |
|
was [has previously been] suspended as the result of an offense |
|
involving the operation of a motor vehicle while intoxicated, the |
|
offense is a Class B misdemeanor. |
|
SECTION 2. Section 521.457(f), Transportation Code, is |
|
repealed. |
|
SECTION 3. The change in law made by this Act applies only |
|
to an offense committed on or after the effective date of this Act. |
|
An offense committed before the effective date of this Act is |
|
governed by the law in effect on the date the offense was committed, |
|
and the former law is continued in effect for that purpose. For |
|
purposes of this section, an offense was committed before the |
|
effective date of this Act if any element of the offense occurred |
|
before that date. |
|
SECTION 4. This Act takes effect September 1, 2017. |
