A BILL TO BE ENTITLED
 
AN ACT
  relating to contracts between Medicaid managed care organizations
  and certain providers of behavioral health and physical health
  services.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 533.00255(c), Government Code, is
  amended to read as follows:
         (c)  A managed care organization that contracts with the
  commission under this chapter shall:
               (1)  develop a network of public and private providers
  of behavioral health services and ensure adults with serious mental
  illness and children with serious emotional disturbance have access
  to a comprehensive array of services; and
               (2)  if the managed care organization intends to
  contract with an integrated provider site for the provision of both
  behavioral health services and physical health services, offer the
  integrated provider site the option of entering into a single
  contract with the managed care organization to provide those
  services, even if the managed care organization contracts with a
  behavioral health organization to coordinate the provision of
  behavioral health services for the managed care organization.
         SECTION 2.  Section 533.00255(c), Government Code, as
  amended by this Act, applies to a contract entered into or renewed
  on or after the effective date of this Act.
         SECTION 3.  If before implementing any provision of this Act
  a state agency determines that a waiver or authorization from a
  federal agency is necessary for implementation of that provision,
  the agency affected by the provision shall request the waiver or
  authorization and may delay implementing that provision until the
  waiver or authorization is granted.
         SECTION 4.  This Act takes effect September 1, 2017.
