A BILL TO BE ENTITLED

AN ACT

relating to costs of an election contest regarding a ballot |
|
|
measure. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

|
SECTION 1. Section 233.003(c), Election Code, is amended to |
|
|
read as follows: |
|
|
(c) The costs of an election contest may not be assessed |
|
|
against a contestee specified by this section. The costs of an |
|
|
election may be assessed [or] against the governmental or political |
|
|
entity the contestee represents. |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
an election ordered on or after September 1, 2017. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
