A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to provision of certain preventive health care services to |
|
|
certain health benefit plan and health maintenance organization |
|
|
enrollees. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 843, Insurance Code, is |
|
|
amended by adding Section 843.324 to read as follows: |
|
|
Sec. 843.324. CONTRACT PROVISION RELATING TO PREVENTIVE |
|
|
HEALTH CARE SERVICES. A contract between a health maintenance |
|
|
organization and a physician or provider requiring the physician or |
|
|
provider to provide preventive health care services to enrollees |
|
|
must require the physician or provider to provide covered |
|
|
preventive health care services to an enrollee not later than the |
|
|
30th day after the date the enrollee requests an appointment with |
|
|
the physician or provider for the preventive health care services. |
|
|
SECTION 2. Subchapter B, Chapter 1301, Insurance Code, is |
|
|
amended by adding Section 1301.070 to read as follows: |
|
|
Sec. 1301.070. CONTRACT PROVISION RELATING TO PREVENTIVE |
|
|
HEALTH CARE SERVICES. A preferred provider contract requiring the |
|
|
preferred provider to provide preventive health care services to |
|
|
insureds must require the preferred provider to provide covered |
|
|
preventive health care services to an insured not later than the |
|
|
30th day after the date the insured requests an appointment with the |
|
|
preferred provider for the preventive health care services. |
|
|
SECTION 3. Sections 843.324 and 1301.070, Insurance Code, |
|
|
as added by this Act, apply only to a contract entered into or |
|
|
renewed on or after January 1, 2018. |
|
|
SECTION 4. This Act takes effect September 1, 2017. |
