A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to providing or administering low-THC cannabis to a child |
|
for whom the low-THC cannabis was prescribed. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 487.001, Health and Safety Code, is |
|
amended by adding Subdivision (5) to read as follows: |
|
(5) "Child" means a person under 18 years of age. |
|
SECTION 2. Subchapter B, Chapter 487, Health and Safety |
|
Code, is amended by adding Section 487.055 to read as follows: |
|
Sec. 487.055. PROVISION OR ADMINISTRATION TO CHILD. It is |
|
not child abuse or neglect, as those terms are defined under Section |
|
261.001, Family Code, for a parent or other caregiver to provide or |
|
administer low-THC cannabis to a child for whom the low-THC |
|
cannabis was prescribed under Chapter 169, Occupations Code. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
