A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the time for holding certain runoff elections. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sections 2.025(c) and (d), Election Code, are |
|
|
amended to read as follows: |
|
|
(c) This section supersedes a law outside this code |
|
|
[subchapter] to the extent of any [a] conflict notwithstanding |
|
|
Section 2.022. |
|
|
(d) Except as otherwise provided by this code, a [A] runoff |
|
|
election for a special election to fill a vacancy in Congress or a |
|
|
special election to fill a vacancy in the legislature [to which
|
|
|
Section 101.104 applies] shall be held not earlier than the 70th day |
|
|
or later than the 84th [77th] day after the date the final canvass |
|
|
of the main election is completed. |
|
|
SECTION 2. Section 203.004(b), Election Code, is amended to |
|
|
read as follows: |
|
|
(b) If the election is to be held as an emergency election, |
|
|
it shall be held on a Tuesday or Saturday occurring on or after the |
|
|
36th day and before the 50th day after the date the election is |
|
|
ordered. Any necessary runoff election must be held on a Tuesday or |
|
|
Saturday occurring not earlier than the 20th day or later than the |
|
|
45th day after the date the final canvass of the main election is |
|
|
completed. |

|
SECTION 3. The change in law made by this Act applies only |
|
|
to an election ordered on or after the effective date of this Act. |
|
|
An election ordered before the effective date of this Act is |
|
|
governed by the law in effect when the election was ordered, and the |
|
|
former law is continued in effect for that purpose. |
|
|
SECTION 4. This Act takes effect September 1, 2017. |
