A BILL TO BE ENTITLED
 
AN ACT
  relating to the time for holding certain runoff elections.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sections 2.025(c) and (d), Election Code, are
  amended to read as follows:
         (c)  This section supersedes a law outside this code
  [subchapter] to the extent of any [a] conflict notwithstanding
  Section 2.022.
         (d)  Except as otherwise provided by this code, a [A] runoff
  election for a special election to fill a vacancy in Congress or a
  special election to fill a vacancy in the legislature [to which
  Section 101.104 applies] shall be held not earlier than the 70th day
  or later than the 84th [77th] day after the date the final canvass
  of the main election is completed.
         SECTION 2.  Section 203.004(b), Election Code, is amended to
  read as follows:
         (b)  If the election is to be held as an emergency election,
  it shall be held on a Tuesday or Saturday occurring on or after the
  36th day and before the 50th day after the date the election is
  ordered. Any necessary runoff election must be held on a Tuesday or
  Saturday occurring not earlier than the 20th day or later than the
  45th day after the date the final canvass of the main election is
  completed.
         SECTION 3.  The change in law made by this Act applies only
  to an election ordered on or after the effective date of this Act.
  An election ordered before the effective date of this Act is
  governed by the law in effect when the election was ordered, and the
  former law is continued in effect for that purpose.
         SECTION 4.  This Act takes effect September 1, 2017.
