A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a restriction on the types of oil and gas wastes that |
|
may be disposed of in a surface pit without a permit issued by the |
|
Railroad Commission of Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 91, Natural Resources |
|
Code, is amended by adding Section 91.1014 to read as follows: |
|
Sec. 91.1014. DISPOSAL OF CERTAIN OIL AND GAS WASTES. The |
|
commission may not authorize by rule the surface disposal of oil and |
|
gas waste without a permit if the oil and gas waste has: |
|
(1) a chloride concentration of more than 3,000 |
|
milligrams per liter; |
|
(2) a total petroleum hydrocarbon concentration of |
|
more than 10,000 milligrams per kilogram; or |
|
(3) a concentration of benzene, toluene, |
|
ethylbenzene, and xylene of more than 30 milligrams per kilogram. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
