A BILL TO BE ENTITLED

AN ACT
|
|
relating to the delegation of prescriptive authority by physicians. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 157.0512, Occupations Code, is amended |
|
by adding Subsection (j-1) to read as follows: |
|
(j-1) A physician may not request or receive remuneration |
|
for delegating prescriptive authority to an advanced practice |
|
registered nurse or physician assistant. |
|
SECTION 2. This Act applies only to a delegation of |
|
prescriptive authority given on or after the effective date of this |
|
Act. A delegation given before the effective date of this Act is |
|
governed by the law as it existed immediately before that date, and |
|
the former law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2017. |
