A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to municipal building regulations that require a license |
|
|
for constructing a commercial or residential structures. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter G, Chapter 214, Local Government |
|
|
Code, is amended by adding Section 214.221 to read as follows: |
|
|
SECTION 214.221. PROHIBITION TO REQUIRE A LOCAL LICENSE FOR |
|
|
CONSTRUCTION OR REMODEL OF A COMMERCIAL OR RESIDENTIAL STRUCTURE. |
|
|
(a) A local governmental entity may not require a builder or |
|
|
contractor to obtain a local license through ordinance for the |
|
|
construction or remodel of a commercial or residential structure. |

SECTION |
|
|
A2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
