A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the conduct of a live sound study after the completion |
|
|
of certain transportation projects. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|
|
is amended by adding Section 201.6105 to read as follows: |
|
|
Sec. 201.6105. LIVE SOUND STUDY. Not later than one year |
|
|
after the department completes a transportation project that |
|
|
includes a sound barrier, the department shall conduct a live sound |
|
|
study to assess the implementation and effectiveness of the sound |
|
|
barrier. If the results of the study show that sound mitigation |
|
|
does not meet projected and modeled forecasts, the department shall |
|
|
modify the existing sound barrier or construct a new sound barrier |
|
|
to meet the forecasts. |

|
SECTION 2. Chapter 372, Transportation Code, is amended by |
|
|
adding Subchapter D to read as follows: |
|
|
SUBCHAPTER D. TOLL PROJECT CONSTRUCTION |
|
|
Sec. 372.151. LIVE SOUND STUDY. Not later than one year |
|
|
after a toll project entity completes a toll project that includes a |
|
|
sound barrier, the toll project entity shall conduct a live sound |
|
|
study to assess the implementation and effectiveness of the sound |
|
|
barrier. If the results of the study show that sound mitigation |
|
|
does not meet projected and modeled forecasts, the toll project |
|
|
entity shall modify the existing sound barrier or construct a new |
|
|
sound barrier to meet the forecasts. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
