A BILL TO BE ENTITLED
 
AN ACT
  relating to the use of certain public buildings as polling place
  locations.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 25.081, Education Code, is amended by
  adding Subsection (f) to read as follows:
         (f)  If a school district is unable to provide space for a
  polling place as required by Section 43.031(f), Election Code, in
  odd-numbered years on the uniform election date in November
  provided by Section 41.001, Election Code, or in even-numbered
  years on the date of the general election for state and county
  officers provided by Section 41.002, Election Code, the school
  district may choose to designate a date described by this
  subsection as a school holiday or a staff development day.
         SECTION 2.  Section 43.031, Election Code, is amended by
  adding Subsection (f) to read as follows:
         (f)  An entity that owns or controls a public building
  selected for a polling place under this section shall ensure the
  building has space designated that:
               (1)  is large enough to accommodate the number of
  voting booths and other election equipment and the staff necessary
  to conduct voting at the polling place; and
               (2)  provides an area where voters may vote privately.
         SECTION 3.  This Act applies beginning with the 2017-2018
  school year.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
