A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the sale of mobility motor vehicles by certain dealers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 2301, Occupations Code, is |
|
|
amended by adding Section 2301.2521 to read as follows: |
|
|
Sec. 2301.2521. SALE OF NEW MOTOR VEHICLES BY CERTAIN |
|
|
DEALERS. Notwithstanding Section 2301.252(a), a person who holds a |
|
|
franchised dealer's license issued under this chapter may sell a |
|
|
new mobility motor vehicle that is a conversion, regardless of |
|
|
whether the person is a franchisee for the make of the motor vehicle |
|
|
that was converted, if the person obtains the new mobility motor |
|
|
vehicle from an independent mobility motor vehicle dealer operating |
|
|
in a county that borders Lake Palestine and has a population of more |
|
|
than 200,000. |

|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
