A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the sale of a motor vehicle with an open product recall. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 2301, Occupations Code, is |
|
|
amended by adding Section 2301.364 to read as follows: |
|
|
Sec. 2301.364. PROHIBITION: SALE OF VEHICLE WITH OPEN |
|
|
PRODUCT RECALL. (a) For purposes of this section, a motor vehicle |
|
|
has an open product recall if the vehicle is subject to a |
|
|
manufacturer's product recall and the vehicle has not been repaired |
|
|
according to the terms of the recall. |
|
|
(b) A dealer may not sell or offer to sell a motor vehicle, |
|
|
including a used motor vehicle, with an open product recall. |
|
|
SECTION 2. This Act takes effect September 1, 2017. |
