A BILL TO BE ENTITLED
 
AN ACT
  relating to the locations where a person may openly carry a
  holstered handgun.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 46.035(f)(1), Penal Code, is amended to
  read as follows:
         Sec. 46.035(f)(1)  "Amusement Park" means an [permanent]
  indoor or outdoor facility or park where amusement rides are
  available for use by the public that is;
                     (A)  located in a county with a population of more
  than one million[,];
                     (B)  encompasses at least 75 acres in surface
  area[,];
                     (C)  makes amusement rides available for use by
  the public for at least 21 consecutive days each calendar year,
                     (D)  is enclosed with access only through
  controlled entries while the amusement rides are available for use
  by the public [, is   open for operation more than 120 days in   each
  calendar year,] and;
                     (E)  has security guards on the premises at all
  times while amusement rides are available for use by the public.  
  The term does not include any public or private driveway, street,
  sidewalk or walkway, parking lot, parking garage, or other parking
  area that is outside the enclosed area described in subsection
  (1)(D) of the preceding sentence. Nor does it include any facility
  or park on days that amusement rides are not available for use by
  the public.
         SECTION 2.  This Act takes effect September 1, 2017.
