A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the evidence of a good faith effort of a state agency to |
|
|
reach goals established for historically underutilized businesses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2161.127(b)(3), Government Code, is |
|
|
amended to read as follows: |
|
|
(3) if the goals established under Section |
|
|
2161.123(d)(5) were not met during the two calendar years preceding |
|
|
the calendar year in which the request is submitted: |
|
|
(A) a statement of the percentage by which the |
|
|
agency's actual use of historically underutilized businesses |
|
|
deviated from the agency's goals; and |
|
|
(B) an explanation of why the goals were not met. |
|
|
(C) an affidavit that the agency has attempted to |
|
|
reach goals in good faith. |
|
|
(D) a plan with specific measures the agency will |
|
|
adopt to attempt to reach goals in the future. |

SECTION 2. This Act takes effect September 1, 2017. |
