A BILL TO BE ENTITLED
 
AN ACT
  relating to the evidence of a good faith effort of a state agency to
  reach goals established for historically underutilized businesses.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2161.127(b)(3), Government Code, is
  amended to read as follows:
               (3)  if the goals established under Section
  2161.123(d)(5) were not met during the two calendar years preceding
  the calendar year in which the request is submitted:
                     (A)  a statement of the percentage by which the
  agency's actual use of historically underutilized businesses
  deviated from the agency's goals; and
                     (B)  an explanation of why the goals were not met.
                     (C)  an affidavit that the agency has attempted to
  reach goals in good faith.
                     (D)  a plan with specific measures the agency will
  adopt to attempt to reach goals in the future.
 
         SECTION 2.  This Act takes effect September 1, 2017.
