A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a daily storage fee charged by a vehicle storage |
|
|
facility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2303.155(d), Occupations Code, is |
|
|
amended to read as follows: |
|
|
(d) For purposes of imposing a daily storage fee, a day is |
|
|
considered to begin 24 hours from the time that the vehicle is towed |
|
|
to a vehicle storage facility [at midnight and to end at the next
|
|
|
following midnight] until the same time the next following day. A |
|
|
daily storage fee may [be charged regardless of whether the vehicle
|
|
|
is stored for 24 hours of the day, except that a daily storage fee
|
|
|
may not be charged for more than one day] if the vehicle remains at |
|
|
the facility for less than 24 [12] hours. |
|
|
SECTION 2. Section 2303.155(d), Occupations Code, as |
|
|
amended by this Act, applies only to a vehicle that is towed to a |
|
|
vehicle storage facility on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
