A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to prohibited denial of a stay of proceedings for a |
|
|
contested case for which an interlocutory appeal has been filed. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 2001, Government Code, is |
|
|
amended by adding Section 2001.063 to read as follows: |
|
|
Sec. 2001.063. INTERLOCUTORY APPEAL. A state agency or an |
|
|
administrative law judge may not deny a request for a stay of |
|
|
proceedings in a contested case for which an interlocutory appeal |
|
|
has been filed. |
|
|
SECTION 2. This Act takes effect September 1, 2017. |
