A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authorization of health benefit plans that do not |
|
|
contain state-mandated health benefits. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 1507, Insurance Code, is amended by |
|
|
adding Subchapter C to read as follows: |
|
|
SUBCHAPTER C. CATASTROPHIC PLANS |
|
|
Sec. 1507.100. CATASTROPHIC HEALTH BENEFIT PLANS. |
|
|
Notwithstanding Subchapters A and B or any existing requirement, a |
|
|
health carrier or health maintenance organization may offer a |
|
|
catastrophic health benefit plan that does not include |
|
|
state-mandated health benefits as described by 1507.003(a) and |
|
|
1507.053(a). |

|
SECTION 2. The changes in law made by this Act apply only to |
|
|
a standard health benefit plan that is delivered, issued for |
|
|
delivery, or renewed on or after September 1, 2017. A policy |
|
|
delivered, issued for delivery, or renewed before September 1, |
|
|
2017, is governed by the law as it existed immediately before the |
|
|
effective date of this Act, and that law is continued in effect for |
|
|
that purpose. |

SECTION 3. This Act takes effect September 1, 2017. |
