A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the jurisdiction of courts in criminal matters |
|
involving allegations of sexual assault by a member of the state |
|
military forces. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 432, Government Code, is |
|
amended by adding Section 432.006 to read as follows: |
|
Sec. 432.006. PROSECUTION OF SEXUAL ASSAULT. (a) A |
|
criminal case alleging a sexual assault committed by a member of the |
|
state military forces must first be tried in an appropriate state |
|
court with jurisdiction over the case. |
|
(b) A military court may not try a person subject to this |
|
chapter for committing an offense described by Subsection (a) until |
|
any state prosecution of the offense is complete. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
