A JOINT RESOLUTION
|
|
proposing a constitutional amendment prohibiting the governor from |
|
appointing certain prosecuting attorneys to fill a vacancy of a |
|
district judge. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 28, Article V, Texas Constitution, is |
|
amended by adding Subsection (a-1) to read as follows: |
|
(a-1) To fill a vacancy in the office of a District Judge, |
|
the Governor may not appoint a person who within the two years |
|
immediately preceding the date of appointment prosecuted any |
|
criminal case in a district court as a District Attorney, Criminal |
|
District Attorney, County Attorney, or assistant District |
|
Attorney, Criminal District Attorney, or County Attorney. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 7, 2017. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment prohibiting the |
|
governor from appointing certain prosecuting attorneys to fill a |
|
vacancy of a district judge." |
