A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to term limits for elected officers of political |
|
subdivisions. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 601, Government Code, is amended by |
|
adding Section 601.010 to read as follows: |
|
Sec. 601.010. ADOPTION OF TERM LIMIT FOR CERTAIN LOCAL |
|
OFFICERS REQUIRED. (a) The governing body of a political |
|
subdivision shall adopt a limit on the number of terms that a person |
|
may serve for each elected office of that subdivision as provided by |
|
this section. |
|
(b) The term limit adopted under this section must ensure |
|
that a person may not serve longer than 12 years in an office, |
|
regardless of whether the person serves consecutive terms. |
|
(c) Service in the same office for a different precinct or |
|
place is counted toward the limit described by Subsection (b). |
|
(c-1) A term that begins before January 1, 2019, is not |
|
counted in determining whether a person is eligible to serve as an |
|
officer of a political subdivision. This subsection expires |
|
February 1, 2035. |
|
(c-2) A political subdivision shall establish the term |
|
limits as required by Subsection (a) not later than January 1, 2018. |
|
This subsection expires January 1, 2019. |
|
SECTION 2. This Act takes effect on the date on which the |
|
constitutional amendment proposed by the 85th Legislature, Regular |
|
Session, 2017, requiring a political subdivision of this state to |
|
limit the number of terms for which a person may be elected to hold |
|
an office of the political subdivision is approved by the voters. |
|
If that amendment is not approved by the voters, this Act has no |
|
effect. |
