A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to Texas Department of Transportation expenditures for |
|
|
toll facility acquisition and construction. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 222, Transportation Code, |
|
|
is amended by adding Section 222.102 to read as follows: |
|
|
Sec. 222.102. LIMITATIONS ON EXPENDITURES FOR TOLL FACILITY |
|
|
CONSTRUCTION AND ACQUISITION. (a) Notwithstanding Sections |
|
|
222.101 and 222.103, beginning September 1, 2031, the department |
|
|
may not spend money for the construction or acquisition of toll |
|
|
facilities. |
|
|
(b) Each state fiscal biennium, the department may spend for |
|
|
the construction and acquisition of toll facilities not more than |
|
|
an amount equal to a percentage of the amount spent for those |
|
|
purposes in the preceding state fiscal biennium as follows: |
|
|
(1) 90 percent for the 2018-2019 and 2020-2021 state |
|
|
fiscal bienniums; |
|
|
(2) 80 percent for the 2022-2023 state fiscal |
|
|
biennium; |
|
|
(3) 70 percent for the 2024-2025 and 2026-2027 state |
|
|
fiscal bienniums; |
|
|
(4) 60 percent for the 2028-2029 state fiscal |
|
|
biennium; and |
|
|
(5) 50 percent for the 2030-2031 state fiscal |
|
|
biennium. |

|
(c) This subsection and Subsection (b) expire January 1, |
|
|
2032. |
|
|
SECTION 2. This Act takes effect September 1, 2017. |
