A BILL TO BE ENTITLED
 
AN ACT
  relating to the entitlement of a public school student to transfer
  to a public school campus with a higher overall performance rating
  under the school accountability system.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 25, Education Code, is
  amended by adding Section 25.044 to read as follows:
         Sec. 25.044.  TRANSFER TO CAMPUS WITH HIGHER PERFORMANCE
  RATING. (a) A student may transfer to another public school campus
  as provided by this section if the campus to which the student seeks
  to transfer is assigned an overall performance rating under Section
  39.054 that is at least two letter grades higher than the overall
  performance rating under Section 39.054 assigned to the campus the
  student would otherwise attend.
         (b)  Except as provided by Subsection (c), a student may
  transfer in accordance with Subsection (a) to another campus in the
  district in which the student resides or to another campus in
  another district.
         (c)  A school district shall admit a student entitled to
  transfer under this section to the campus selected by the student
  unless the campus does not have available capacity. A school
  district that receives more requests to transfer to a campus under
  this section than the number of available positions at the campus
  must fill the available positions by lottery.
         (d)  After a student transfers to another campus in
  accordance with this section, the student may continue attending
  that campus in subsequent school years regardless of the subsequent
  overall performance ratings under Section 39.054 of the campus to
  which the student transferred and the campus that the student would
  otherwise attend.
         (e)  A student who transfers to another campus under this
  section, including a campus in a district other than the district in
  which the student resides, may not be charged tuition. The student
  is included in the average daily attendance of the district in which
  the student attends school.
         (f)  The commissioner may adopt rules necessary to implement
  this section.
         SECTION 2.  Subchapter C, Chapter 42, Education Code, is
  amended by adding Section 42.1571 to read as follows:
         Sec. 42.1571.  TRANSFER STUDENT ALLOTMENT. (a) Except as
  provided by Subsection (b), for each student in average daily
  attendance who transfers in accordance with Section 25.044 to a
  campus in a district other than the district in which the student
  resides, the district in which the student attends school is
  entitled to an annual allotment equal to the adjusted basic
  allotment multiplied by a weight of 0.1.
         (b)  The total number of allotments under this section to
  which a district is entitled may not exceed the number by which the
  number of students transferring to campuses in the district exceeds
  the number of students who reside in the district and transfer in
  accordance with Section 25.044 to campuses in another district.
         SECTION 3.  This Act applies beginning with the 2018-2019
  school year.
         SECTION 4.  This Act takes effect September 1, 2017.
