A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an offense report prepared in the investigation of |
|
|
certain criminal cases. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 2, Code of Criminal Procedure, is |
|
|
amended by adding Article 2.1397 to read as follows: |
|
|
Art. 2.1397. OFFENSE REPORT: RESISTING OR EVADING ARREST. |
|
|
An offense report prepared in the investigation of a criminal case |
|
|
in which a person is alleged to have resisted or evaded arrest under |
|
|
Section 38.03 or 38.04, Penal Code, must state the underlying |
|
|
offense for which the person was resisting or evading arrest. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an offense report prepared on or after the effective date of this |
|
|
Act. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
