A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a limitation on the amount of attorney's fees awarded in |
|
a case assigned to a special three-judge district court. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 22A, Government Code, is amended by |
|
adding Section 22A.0055 to read as follows: |
|
Sec. 22A.0055. ATTORNEY'S FEES. In a case assigned to a |
|
special three-judge district court under this chapter and in any |
|
related case consolidated with the case before the court, the court |
|
may not award attorney's fees in an amount that exceeds $250,000. |
|
SECTION 2. Section 22A.0055, Government Code, as added by |
|
this Act, applies only to a case assigned to a special three-judge |
|
district court on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
