A BILL TO BE ENTITLED
 
AN ACT
  relating to the transfer of alcoholic beverages between certain
  noncontiguous permitted premises.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 25, Alcoholic Beverage Code, is amended
  by adding Section 25.15 to read as follows:
         Sec. 25.15.  TRANSFER OF BEVERAGES. (a) This section
  applies only to a wine and beer retailer's permit holder who holds
  permits for not more than five noncontiguous permitted premises
  located in a facility that is:
               (1)  operated for public entertainment involving
  waterslides, food service, music, and amusement activities; and
               (2)  located primarily along the banks of the Comal
  River.
         (b)  Notwithstanding any other law, the holder of the wine
  and beer retailer's permits described by Subsection (a) may
  transfer alcoholic beverages between the permitted premises in the
  facility described by Subsection (a) and another permitted facility
  that is:
               (1)  operated by the permit holder; and 
               (2)  located in the same county as the facility
  described by Subsection (a).
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
