A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a municipality to remove directors of |
|
|
certain conservation and reclamation districts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 178, Local Government Code, is amended |
|
|
by adding Subchapter Z to read as follows: |
|
|
SUBCHAPTER Z. MISCELLANEOUS PROVISIONS |
|
|
Sec. 178.901. REMOVAL OF DIRECTORS APPOINTED BY |
|
|
MUNICIPALITY TO CERTAIN BOARDS. Notwithstanding any other law, a |
|
|
director of a conservation and reclamation district created under |
|
|
Section 59, Article XVI, Texas Constitution, who is appointed by |
|
|
the governing body of a municipality, serves at the pleasure of the |
|
|
governing body and may be removed by the governing body at any time |
|
|
without cause. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
