A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the use of cigarettes, e-cigarettes, or tobacco |
|
|
products on property owned by or leased for a state agency. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 2165, Government Code, is amended by |
|
|
adding Subchapter A-1 to read as follows: |
|
|
SUBCHAPTER A-1. CIGARETTE, E-CIGARETTE, OR TOBACCO PRODUCT USE ON |
|
|
STATE PROPERTY |
|
|
Sec. 2165.031. APPLICABILITY. Notwithstanding Section |
|
|
2165.002, this subchapter applies to any property owned by this |
|
|
state and used by a state agency, including an institution of higher |
|
|
education as defined by Section 61.003, Education Code. |
|
|
Sec. 2165.032. DEFINITIONS. In this subchapter: |
|
|
(1) "Cigarette" has the meaning assigned by Section |
|
|
154.001, Tax Code. |
|
|
(2) "E-cigarette" has the meaning assigned by Section |
|
|
161.081, Health and Safety Code. |
|
|
(3) "Tobacco product" has the meaning assigned by |
|
|
Section 155.001, Tax Code. |
|
|
Sec. 2165.033. PROHIBITION OF CIGARETTE, E-CIGARETTE, OR |
|
|
TOBACCO PRODUCT USE ON STATE PROPERTY. The use of a cigarette, |
|
|
e-cigarette, or tobacco product is prohibited in any building or on |
|
|
any grounds owned by this state and used by a state agency. |
|
|
SECTION 2. Chapter 2167, Government Code, is amended by |
|
|
adding Subchapter A-1 to read as follows: |
|
|
SUBCHAPTER A-1. CIGARETTE, E-CIGARETTE, OR TOBACCO PRODUCT USE IN |
|
|
SPACE LEASED BY STATE AGENCY |
|
|
Sec. 2167.031. APPLICABILITY. Notwithstanding Section |
|
|
2167.001, this subchapter applies to any space used by a state |
|
|
agency, including an institution of higher education as defined by |
|
|
Section 61.003, Education Code. |
|
|
Sec. 2167.032. DEFINITIONS. In this subchapter: |
|
|
(1) "Cigarette" has the meaning assigned by Section |
|
|
154.001, Tax Code. |
|
|
(2) "E-cigarette" has the meaning assigned by Section |
|
|
161.081, Health and Safety Code. |
|
|
(3) "Tobacco product" has the meaning assigned by |
|
|
Section 155.001, Tax Code. |
|
|
Sec. 2167.033. PROHIBITION ON USE OF CIGARETTES, |
|
|
E-CIGARETTES, AND TOBACCO PRODUCTS IN SPACE LEASED BY STATE AGENCY. |
|
|
The use of a cigarette, e-cigarette, or tobacco product is |
|
|
prohibited in any space leased by this state for the use of a state |
|
|
agency. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
