A BILL TO BE ENTITLED
 
AN ACT
  relating to the prosecution of the offense of impersonating a
  public servant.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 37.11(a), Penal Code, is amended to read
  as follows:
         (a)  A person commits an offense if the person [he]:
               (1)  impersonates a public servant with intent to
  induce another to submit to the person's [his] pretended official
  authority or to rely on the person's [his] pretended official acts;
  [or]
               (2)  knowingly purports to exercise any function of a
  public servant or of a public office, including that of a judge and
  court, and the position or office through which the person [he]
  purports to exercise a function of a public servant or public office
  has no lawful existence under the constitution or laws of this state
  or of the United States; or
               (3)  while serving as mediator or arbitrator, knowingly
  represents to another person that the actor is or was a member of
  the judiciary of this state, any other state, or the United States
  or uses any of the titles "judge," "justice," or "honorable," if the
  actor was not previously elected or appointed to be a member of the
  judiciary of this state, any other state, or the United States.
         SECTION 2.  This Act takes effect September 1, 2017.
