A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the prosecution of the offense of impersonating a |
|
public servant. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 37.11(a), Penal Code, is amended to read |
|
as follows: |
|
(a) A person commits an offense if the person [he]: |
|
(1) impersonates a public servant with intent to |
|
induce another to submit to the person's [his] pretended official |
|
authority or to rely on the person's [his] pretended official acts; |
|
[or] |
|
(2) knowingly purports to exercise any function of a |
|
public servant or of a public office, including that of a judge and |
|
court, and the position or office through which the person [he] |
|
purports to exercise a function of a public servant or public office |
|
has no lawful existence under the constitution or laws of this state |
|
or of the United States; or |
|
(3) while serving as mediator or arbitrator, knowingly |
|
represents to another person that the actor is or was a member of |
|
the judiciary of this state, any other state, or the United States |
|
or uses any of the titles "judge," "justice," or "honorable," if the |
|
actor was not previously elected or appointed to be a member of the |
|
judiciary of this state, any other state, or the United States. |
|
SECTION 2. This Act takes effect September 1, 2017. |
