A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Department of Public Safety to |
|
|
provide notification of a failure to appear in federal court. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 411, Government Code, is |
|
|
amended by adding Section 411.0089 to read as follows: |
|
|
Sec. 411.0089. FEDERAL COOPERATION. (a) The department |
|
|
may enter an agreement with one or more United States district |
|
|
courts in this state under which the court provides the department |
|
|
with notice of a person who fails to comply with a notice to appear |
|
|
for a violation of a traffic law or other regulation in a United |
|
|
States district court in this state. |
|
|
(b) If the department receives notification under |
|
|
Subsection (a) regarding a person's failure to comply with a notice |
|
|
to appear in a United States district court, the department may |
|
|
notify that person of the failure to appear at any appropriate time. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
