A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the operation of a motor vehicle dealership by certain |
|
manufacturers or distributors. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 2301.476, Occupations Code, is amended |
|
by adding Subsection (p) to read as follows: |
|
(p) A person who on January 1, 2017, was an independent |
|
engine manufacturer and held a manufacturer's license issued under |
|
this chapter may: |
|
(1) hold: |
|
(A) a manufacturer's license; |
|
(B) a general distinguishing number issued under |
|
Chapter 503, Transportation Code; and |
|
(C) not more than nine dealer's licenses; and |
|
(2) operate as both a manufacturer and dealer of new |
|
motor vehicles to the extent the person: |
|
(A) manufactures or distributes only engines for |
|
installation in motor vehicles that have: |
|
(i) the transport of persons or property on |
|
a public highway as the primary purpose of the vehicle; and |
|
(ii) a gross vehicle weight rating of more |
|
than 16,000 pounds; and |
|
(B) provides substantially equal access to any |
|
dealer to all support for repairing an engine or motor vehicle |
|
described by Paragraph (A), including access to: |
|
(i) parts and assemblies; |
|
(ii) training and technical service |
|
bulletins; and |
|
(iii) other repair information. |
|
SECTION 2. This Act takes effect September 1, 2017. |
