A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the reimbursement of certain services provided by |
|
respiratory care practitioners under Medicaid. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 531.0216, Government Code, is amended by |
|
adding Subsection (g) to read as follows: |
|
(g) The system developed and implemented under this section |
|
must allow a physician or a health care facility, including a |
|
hospital, to be reimbursed under Medicaid for the following |
|
services performed by a respiratory care practitioner acting under |
|
the delegation and supervision of a physician and acting within the |
|
scope of the respiratory care practitioner's certification or |
|
permit: |
|
(1) telemedicine medical services, telehealth |
|
services, and home telemonitoring services provided by a |
|
respiratory care practitioner located at a distant site to a |
|
patient located at a patient site; and |
|
(2) services provided in support of the delivery of |
|
telemedicine medical services, telehealth services, or home |
|
telemonitoring services by a respiratory care practitioner located |
|
at a patient site to a patient located at the patient site. |

SECTION 2. If before implementing any provision of this Act |
|
a state agency determines that a waiver or authorization from a |
|
federal agency is necessary for implementation of that provision, |
|
the agency affected by the provision shall request the waiver or |
|
authorization and may delay implementing that provision until the |
|
waiver or authorization is granted. |
|
SECTION 3. This Act takes effect September 1, 2017. |
