A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to systems of prior authorization for the control, |
|
|
management, and disposal of certain nonhazardous, industrial solid |
|
|
wastes for which there are minimum federal requirements. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|
|
Code, is amended by adding Section 361.0902 to read as follows: |
|
|
Sec. 361.0902. AUTHORIZATION FOR CONTROL, MANAGEMENT, OR |
|
|
DISPOSAL OF CERTAIN NONHAZARDOUS, INDUSTRIAL SOLID WASTES; |
|
|
HEARING. (a) Notwithstanding any other provision of this chapter |
|
|
relating to permits, the commission by rule may require a |
|
|
registration that requires prior approval, or other system of prior |
|
|
approval, for the control, management, or disposal of industrial |
|
|
solid wastes for which there are minimum federal requirements under |
|
|
the Resource Conservation and Recovery Act of 1976 (42 U.S.C. |
|
|
Section 6901 et seq.). |
|
|
(b) Public hearings on an application for a registration |
|
|
that requires prior approval, or other system of prior approval, |
|
|
required by rules adopted under this section, are not subject to the |
|
|
procedural requirements of Chapter 2001, Government Code, or |
|
|
Chapter 5, Water Code. |
|
|
SECTION 2. Not later than January 1, 2018, the Texas |
|
|
Commission on Environmental Quality shall adopt rules to implement |
|
|
Section 361.0902, Health and Safety Code, as added by this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
